Welcome to Express Battery and Roadside. By requesting, scheduling, authorizing, or accepting roadside assistance services from Express Battery and Roadside ("Company"), you ("Customer" or "Client") agree to the following Terms & Conditions.

1. Services Provided

Express Battery and Roadside provides roadside assistance services including, but not limited to:

• Jump starts
• Battery delivery and installation
• Tire changes
• Lockout assistance
• Fuel delivery
• Basic roadside diagnostics
• Towing coordination

Service availability may vary depending on location, weather, traffic, vehicle condition, and technician availability.

2. Authorization for Service

By requesting service through phone, text, online booking, social media, or any other communication method, you authorize Express Battery and Roadside and its technicians to perform the requested roadside assistance services on your vehicle.

You confirm that:

• You are the vehicle owner or authorized to request service for the vehicle.
• The information you provide about the vehicle and its condition is accurate to the best of your knowledge.
• You understand roadside assistance services involve working on vehicles that may already have pre-existing mechanical, electrical, cosmetic, or structural issues.

3. Limitation of Liability

Express Battery and Roadside, its owners, employees, contractors, technicians, affiliates, and partners shall not be held liable for any damages, losses, costs, claims, or expenses arising from or related to services provided.

This includes, but is not limited to:

• Mechanical failures
• Electrical system issues
• Battery or alternator failure
• Scratches, dents, or cosmetic damage
• Tire, wheel, or lug nut damage
• Lock, door, or window mechanism damage
• Towing-related incidents
• Delays caused by weather, traffic, or unforeseen circumstances
• Pre-existing vehicle conditions

All services are performed at the customer's own risk.

4. Pre-Existing Damage

Express Battery and Roadside is not responsible for identifying, documenting, or repairing pre-existing vehicle damage or issues prior to service. Customers acknowledge that many roadside situations involve vehicles with existing wear, damage, corrosion, dead batteries, stripped lug nuts, aftermarket modifications, or other conditions that may increase risk during service.

5. No Guarantee or Warranty

All services are provided "AS IS" without warranties or guarantees of any kind, either expressed or implied.

Express Battery and Roadside does not guarantee:

• Permanent repair of vehicle issues
• Future vehicle reliability
• That a vehicle will restart, remain running, or operate properly after service
• That additional repairs will not be necessary

6. Payment Policy

Payment is due immediately upon completion or attempted completion of service unless otherwise agreed in writing.

By authorizing service, you agree that:

• The payment is valid and authorized
• You are responsible for all service charges
• Attempted services requested by the customer may still be billable
• Failure to pay may result in collections or legal action.

7. Chargeback & Payment Dispute Policy

By accepting service from Express Battery and Roadside, you agree not to initiate fraudulent or unjustified chargebacks, payment reversals, or disputes after services have been completed or attempted.

Express Battery and Roadside reserves the right to dispute chargebacks using evidence including:

• Call logs
• GPS records
• Technician notes
• Photos or videos
• Text messages
• Invoices
• Payment confirmations
• Customer communications

Fraudulent chargebacks may result in:

• Collection activity
• Additional administrative fees
• Legal action
• Reporting to payment processors or financial institutions

8. Refusal of Service

Express Battery and Roadside reserves the right to refuse or discontinue service at any time for reasons including, but not limited to:

• Unsafe working conditions
• Aggressive or abusive behavior
• Illegal activity
• Unsafe vehicle conditions
• False or misleading service information

9. Website & Communication Consent

By contacting Express Battery and Roadside through our website, phone number, or online forms, you consent to receive calls, text messages, and service-related communications. Standard carrier rates may apply.

10. Changes to Terms

Express Battery and Roadside reserves the right to modify or update these Terms & Conditions at any time without prior notice. Continued use of our services constitutes acceptance of any updated terms.
